Separation of powers divides the national government into three branches. The separation of powers is an essential element of the Rule of Law, and is enshrined in the Constitution. Checks and balances refers to the power that each branch exerts over the others and keeps them from becoming more powerful than one another. Checks and balances make sure that the three powers interact in an equitable and balanced way.
